Driving Under the Influence (DUI) or Driving While Impaired (DWI) involve more scientific knowledge than probably any other crimes that are commonly alleged.  Many attorneys have stated, "If you can defend a DUI, you can defend a Homicide."  There is a lot of truth to that statement.

Education allows a defense attorney to understand what they are defending, and how to do it.  Applying facts to the law, and arguing for the right, the just outcome is a defense attorneys job.  There are different types of education, like the law.  Attorneys learn a lot about the law in law school.  Then there is fact specific education.  DUI's require both fact specific and legal education.

Jonathan Rooker recently completed another semester of his coursework for a Masters Degree in Forensic Toxicology.  The two classes are Bio-transformation and Forensic Toxicology II.  Bio-transformation is how a substance changes or is metabolized within the body.  There are multiple phases of bio-transformation that occur.  This is a significant factor in helping a person form an educated opinion of a person's Blood Alcohol Content at the time they were actually driving a vehicle.

Forensic Toxicology II is likewise geared toward looking at the information we have, and forming an opinion, and educated opinion based on scientifically relevant and valid research results to form an educated opinion on what certain laboratory results indicate.

These classes help Jonathan Rooker argue for scientific based defenses to accusations.  They help Jonathan in DUI, DUI Drug, Drug, even Homicide cases.

Jonathan looks forward to starting his next class on May 17, 2014.  Taking the summer session allows Jonathan to continue to gain relevant knowledge, not common in the field, to give him the edge when defending DUI cases.

The first decision an officer makes during the DUI enforcement is the decision to stop the vehicle. It may be a driving pattern, maintenance infraction, tinted windows, or other issues the lead the officer to make that decision. The next decision is whether to have the driver exit the vehicle and conduct a DUI investigation. Factors include odor or alcohol, red watery eyes, and slurred speech. Timely stopping, parking, and fumbling with a license or insurance paperwork, all influence the officers decision to continue the investigation. Once outside the vehicle the subject may sway or have trouble following directions. At the conclusion of the third stage, the officer decides if there is probable cause for an arrest. If you are arrested, there are steps you should take on your own behalf. It is important for anyone cited for DUI to contact the DMV within 10 days to preserve their right to an Admin Per Se Hearing in front of a DMV officer. Failure to contact the DMV within 10 days may result in the suspension of your driving privilege. Remember, the officer arrests at probable cause, but it takes proof beyond a reasonable doubt to convict. If the officer does their job right, a large percentage of the people should be found not guilty.
