Our clients are ordinary people who need help during a tough period in their life.  Most have jobs, families, and responsibilities in life that merely require a little help to move forward in life.  A typical DUI client may have be employed as a Class A driver, be looking forward to a retirement from the company they have worked for over a period of years, and be at risk of losing their home, retirement, and career due to a questionable arrest for DUI.  I want to help good people, who have lived responsible lives, continue to be productive members of our society.  We have over criminalized society, and create an environment that punishes absent an understanding that people make mistakes.

Why help a Drunk Driver?

Many time people ask how I could help an (alleged) drunk driver.  Don't I know that drunk driving costs lives?  Of course I do, I've seen it first hand.  I was struck be a DUI driver, received injuries, my girlfriend was also injured along with other people. If we dehumanize a human being by referring to them as a "drunk driver" then it is easy to take that approach.  In my situation this person was a human being, a teacher, who had worked with my father, and was in the prime of her life.  Due to a drunk driving arrest she made a horrible choice, and it cost her a career she had worked hard for. Subsequently, due to a DUI, she took her own life.  Would you want to help a person in her situation?  I do.

Most of my clients who are accused of domestic violence aren't bad people.  Many times they have lived good lives, been in long term relationships with people they love, and been a good spouse.  Life has stress, and being human, they add up.  A moment of indiscretion can snowball into serious charge such as domestic violence.  Soon a restraining order is issued, families are torn apart, and the entire family is victimized by the court system.  Seeing families torn apart is never good, especially when they are good, stable, loving family that has their problems exasperated by courts that have their own political motives in mind for their actions.

Why help an accused Domestic Violence Client?

Seeing the damage that the courts and criminal justice systems inflict upon families, many times it ends up being the real abuse.  An accusation, absent any proof, and usually based on an officers interpretation of a statement by one party, can cause a family to be prohibited from contact for the duration of the pending adjudication, and many times even longer.  Long term marriages, with children, and mutual obligations, suffering during a stressful time, can cause an accusation to be made.  Then, the justice systems gets involved, and a case can take years to resolve, all the while the husband and wife, or significant others are prohibited from seeing or even talking to each other.

Violent and Gang Crimes

Our clients may be accused of serious felonies such as gang crimes, murder, attempted murder, and other such crimes.  However, an accusation is far from defining the person that they are.  They may be good people, from loving families, who did nothing wrong but be born into an area or have relatives who are involved in gang crimes.  People are falsely accused, and on occasion the wrong person is imprisoned.  There are times when a violent crime is nothing more than a false allegation, self defense, or the wrong individual is arrested and charged. Imagine spending months in jail for no reason.  Being innocent of the crime, knowing you worked that day, all day, and wasn't even close to the location of the crime, but having an overzealous government agent fabricate evidence against you because they believed you really were involved and were out to prove their case at any cost.  The truth can be lost if the investigation goes the wrong direction and wont look reasonably at evidence that points the other direction, toward innocence of the person they accused of committing the crime.  Many times our clients are over charged.  There may be good reason to believe they have committed a crime or an infraction, but not the crime they are accused of.  In such situations we act to mitigate the damages by investigating the situation, interviewing witnesses, and various other techniques to flush our the reality that our client is innocent of what they have been accused of, even if they may be guilty of something much less serious in nature.

How could you I help a gang member or defend a person accused of shooting someone?

I have heard this many times.  I learned early in may career that police can make mistakes, and while rare, they can also be very wrong in their beliefs and create evidence to justify their expectation.  I watched an innocent young man, barely in his 20's with not real criminal record sit in jail for six months, all while trying to convince a DA that he was innocent.  I have proof, statements, and a video of him at the store, which the DA also had but refused to turn over or even watch with me.  The defendant even used his credit card, and several of the alibi witnesses were with him at the store, visible on the film, along with the vehicle they arrived in. I spoke with the victim, who lived in close proximity, and was able to name the person who actually shot him, who wasn't my client.  He said the police told him he that my client shot him, circle the guy the guy that shot you, and put your initials in it.  He argued for a while, then did it.  The co-defendant told who really did the shooting, but the officers said he was lying, and they badgered him into finally saying he was with my client.  At preliminary hearing my client was released from jail, no longer facing gun, gang, and attempted homicide charges that could have resulted in a long prison sentence.  Having spent six months in jail for nothing more than going to work that day.  Shouldn't society be happy for justice, and applaud criminal defense attorney's for saving us from the unbridled discretion of over zealous government workers and the power they are given?
