Fresno Criminal Defense and DUI Lawyer Jonathan Rooker is working toward becoming one of the few DUI Attorneys in the Nation to receive the Designation of Lawyer Scientist from the American Chemical Society.  The process is not an easy one, it includes twice completing the the hands on Gas Chromatography course at Axion labs in Chicago Illinois.  Also, to receive the designation, the lawyer must complete the Solid Drug Mass Spectrometry Course and the DUI Drugs course which includes in depth study of the pharmacology of drugs once they enter the body.  Toxicology is an area that Fresno DUI Attorney Jonathan Rooker excels in.  He is working toward a Masters Degree in Forensic Toxicology, has also attended the National College for DUI Defense seminar on Mastering Scientific Evidence in New Orleans.  As of the writing of this blog, there are approximately eight lawyers nationwide who have received this highly prestigious designation.  Jonathan will attend the second of the four courses in November when he is scheduled to participate in the Solid Drug Mass Spectrometry course.

Jonathan has been focused on learning as much science as he can since he's become an Attorney, and he has taken every opportunity to attend meetings of the California DUI Lawyers Association along with attending The National College For DUI Defense seminar in New Orleans.  His study of the science involved in Pharmacology of Alcohol and drugs when entering the body, absorbing, distribution, and being eliminated from the body includes his academic pursuits of his second Masters Degree.  The absorption of alcohol is of primary concern to any DUI Attorney when entering trial.  While some "experts" will testify to full absorption in as little as 15 minutes, science routinely states otherwise.  Academic text books on the treatment of alcohol will state that it takes 60 minutes for 80-90 percent of the alcohol ingested to be absorbed into the blood.  If other factors are present such as food, gastrointestinal disorders, pyloric spasms, or many other factors, it could take anywhere from 2-6 hours to fully absorb alcohol after it has been ingested orally.

Many experts such as one of the leading experts on the absorption of alcohol into the human body, Dr. Kurt Dubowski have researched the subject extensively utilizing simultaneous blood draw and breath analysis.  Their research states that it takes on average over 2 hours for full absorption of alcohol after it is ingested orally.  There is a variation in absorption times between makes and females.

It is important to understand the true absorption and elimination times involved when consuming alcohol, as it allows you to better estimate your blood alcohol content.  It is also important to know that if drinking late in the evening, and consuming large quantities of food, you may still have a considerable amount of alcohol in your systems when you wake up in the morning.

The first decision an officer makes during the DUI enforcement is the decision to stop the vehicle. If the officer does their job right, a large percentage of the people should be found not guilty.
