Jonathan Rooker weighs in on a newspaper article alleging a DUI Accident in Kingsburg
A recent allegation of DUI accident against a woman driving an SUV that crashed following contact with a concrete divider was published in the media. However, I must point out that accidents happen on a regular basis absent any impairment on the drivers part. No Blood alcohol concentration was alleged, and no evidence of drugs, either prescription (Rx), and/or illicit was given. All we have is an accident and allegations absent any evidence that the driver was impaired being provided.
Try not to be quick to judge, this woman may be innocent. Further, if officers do their job right, and arrested based on probable cause, and a jury does their job right and acquits absent proof beyond a reasonable doubt, a large percentage of accusations should result in an acquittal.
As a criminal defense attonrey the worst part is watching juries make the wrong decision. The jury conditioning begins with signs on the freeway from advocate groups and special interest lobbies which state false statements such as, "buzzed driving is drunk driving" which have no basis in law.
