Breath Alcohol Content v. Blood Alcohol Content:

Many lawyers understand what a partition ration is, but few can tell you what assumptions and facts are used in calculating a partition ration.  The breathalyzer or breath machine, uses several assumptions while estimating what a person's blood alcohol content is.  Hematacrit levels, breath temperature, calibration, proper use of the machine, absorption, distribution, and elimination of alcohol from the body and the rates at which it occurs.

Blood Alcohol Testing:

Blood samples are tested by Gas Chromatogrpahy.  This method, when done properly can be very accurate.  However, the machine does not know what alcohol is.  It can only be identified by proper separation of molecules, and finding out the retention time for alcohol.  Then, any volatile substance that exits the machine at a certain time is presumed to be alcohol.  However, at no point in time has every volatile substance being tested to see if any have the same elution time as alcohol.  There are many human factors involved in testing, and understanding them is important to a defense lawyer who wants to properly defend a DUI case involving a blood sample.
