Fresno DUI Defense Attorney Jonathan Rooker discusses the different types of Drug DUI's and the defenses that may be successful in defense such allegations.  Marijuana DUI's are a growing field, as the studies, legalization, and Per Se levels indicating impairment have not been well established. Prescription Drug DUI's, being anti-depressants, pain killers, Opiates, or other narcotics commonly prescribed have also presented several new challenges for both law enforcement's prosecution and defense attorney's defending a relatively new field.

Jonathan has prepared for this emerging field of DUI Drug Defense by nearing completion of his Forensic Toxicology M.S. Degree, with July 2015 being the scheduled dates for his final examinations.  He has also attended multiple in Laboratory and classroom courses pertaining to DUI Drugs, Identification, methods of identification including Mass Spectrometry and Gas Chromatography along with Liquid Chromatography Mass Spectrometry tandem identification.

Many drugs are bound by protein and may have much less than 100% bio-availability to react with the receptors and produce the effect.  Therefore the level of the narcotic in the blood does not tell the whole story about the ability of the drug to produce impairment.  There are many other factors involved, and I would recommend talking with a qualified DUI / DUI Drug Defense Attorney who can answer questions about identification, bio-availability, pharmacodynamics and Pharmakinetics of the substances involved and explain the importance to you, which will help you evaluate your case and make the best decisions.
