Jonathan had the unique task of speaking directly after a criminal defense icon who has been widely regarded as one of the best criminal defense attorneys in history, Tony Serra.  Jonathan presented on the ingestion and digestion of alcohol in the human body, along with absorption of alcohol into the blood stream, and how it affects the breath test results as an estimate of true blood alcohol level.

The process of absorption is much longer than many people believe.  With the overstatement of blood alcohol content based upon the estimate formulated from the breath alcohol content results can be very misleading.  The blood in the lungs has a higher alcohol content during absorption than venous blood, therefore the breath will have more alcohol in it than we can correlate to venous blood.  Understanding absorption is important if the client needs a rising blood alcohol defense, or an overstatement during the absorption period.
