I was caught with drugs, what is my punishment going to be?-  This is a common question, with many possible answers.  Many first time drug offenders choose to protect their record, and their future, by participating in a PC 1000 drug diversion program that results in a dismissal upon successful completion.  Others may be eligible for non-violent drug diversion, commonly referred to as Prop 36.  This is an intensive course of treatment, that includes AA/NA meetings, drug testings, supervision by probation, and routine court appearances.  Both of these option are many times more rigorous than the sentence, but provide the accused with an opportunity to improve their situation, and their future.

Driving on a suspended license is more serious than it sounds.  There are also different categories of driving on a suspended license.  14601.1 can be either a misdemeanor or and infraction.  It is a 2 pt violation for your driving record.  Probation can last for years, and fines can exceed a $1,000.

VC14601.2 is even more serious than a VC 14601.5 violation. 

How bad is the punishment for DUI in Fresno County? Fresno County has a standard sentence for a low blood alcohol concentration first offense DUI's.  The fines, fees, and court costs are nearly $2,000 and 10 days of County Jail are standard for a low blood alcohol concentration of less than .14 on the first offense.  Three (3) years probation is a near certainty upon conviction.  However, the Judges tend to allow a person to serve their 10 days of jail on the Adult Offender Work Program.  Fines may be reduced upon completion of the Decisions for Life Class (formerly scared stiff) by approximately 50%, but that may vary as well.  a 13-week DUI class is the standard for a DUI with a BAC below .15, if the BAC is .20 or above, the DMV will order and 18-month DUI class.  Jail time is likely increased at  BAC of .15, .20, and incrementally thereafter.

The Maximum sentence first offense Misdemeanor DUI is 6 months in County Jail.

When defending DUI Charges otherwise known as VC 23152(b) , it is important to know what to look for.  One of the first tools used is the standardized Field Sobriety Tests.  The officers use the results to try an show impairment in DUI cases.  Jonathan is one of a select few who have been trained to conduct and score SFST's.  SFST's are so important that Jonathan went back to a separate instructors course, to teach others how to perform the SFST's on subjects in DUI investigations.  This allows Jonathan to cross examine officers on their instruction and scoring of the tests.  Fresno is notoriously strict on DUI's, which leads to false accusations.  Citations do not necessarily end in convictions, many are reduced to wet and reckless, reckless driving or other vehicle code violations, dismissed, or even beat at trial.  If you need your case evaluated, Jonathan's superior knowledge of Forensic Toxcilogy, DUI's and SFST's can be essential in helping you reach the right outcome in your case.
